User agreement

USER AGREEMENT

MIDEXPO-exhibitions and fairs LLC (OGRN (Primary State Registration Number) 1027739071348, located at: Russia, Moscow, Presnensky Val st. 21, str. 12, fl. 1, building 196, room 1, of. 17) (hereinafter referred to as “Midexpo” or “Website Rightholder”) hereby invites the Internet User (hereinafter referred to as the “User”) to use Midexpo websites as well as services and content available on these websites subject to the terms stated in this User Agreement (hereinafter — the “Agreement”).

This Agreement shall determine the terms of using by the Users of the content and services available on all websites of Midexpo.

1. General provisions

1.1. Start of using of the Midexpo website (hereinafter - the “Website”) by the User shall mean that the User has read, understood and fully accepted the terms and conditions of this Agreement without any reservations, and shall be liable to comply therewith and with all and any laws and subordinate laws applicable in the Russian Federation.

1.2. This Agreement shall govern relations between the Website Rightholder and the User in terms of the Website using.

1.3. Using of certain services of the Website may be subject to the certain rules to be effective together with this Agreement and, in case of controversies, shall prevail.

1.4. Midexpo shall have the right to change the terms and conditions hereof at any time and in unilateral procedure without prior notification of the User. Such amendments shall come into force upon a new revision of the Agreement becomes available on the website. The User shall be liable to check this Agreement for existence of any amendments at its sole discretion. In case of the User’s disagreement with such amendments the User shall be liable to refuse an access to the Website and to stop using the content and services of the Website.

1.5. Irrespective of the fact of registration or authorization of the User on the Website, using of the Website inclusive of view of the content placed on the Website, shall mean the User’s consent with this User Agreement and assumption of obligations to comply with the instructions for using of the Website services, as well as of responsibility for actions related to the Website using.

1.6. Using of the Website and services and content available thereon shall be governed by this Agreement, the Personal Data Processing Policy (www.en.cstb.ru), as well as applicable legislation of the Russian Federation.

2. Obligations of the User

2.1. The User hereby agrees not to take actions which may be considered as violating the legislation of the Russian Federation or standards of international law, including but not limited to, in the field of intellectual property, copyright and / or related rights, as well as any actions which lead to or may lead to abnormal operation of the Website and services of the Website.

2.2. Using of the Website content without the consent of rightholders shall not be allowed (Article 1270 of the Civil Code of the Russian Federation. For proper use of the Website content it is necessary to conclude the license agreements (obtaining of licenses) by the Rightholders.

2.3. Midexpo shall not provide the User with the rights or licenses, either explicit or implicit, to any designations, trademarks, subject matters of copyrights and other items placed on the Website.

2.4. In case of citing the Website content inclusive of the copyrighted works, the link to the Website shall be required (Subclause 1 Clause 1 Article 1274 of the Civil Code of the Russian Federation).

2.5. Comments and other postings of the User on the Website shall not come into conflict with the requirements of the legislation of the Russian Federation and universal moral principles and rules of morality.

2.6. The User is awared of the fact that the Rightholder of the Website shall not bear responsibility for browsing and using by it of the external sources, links to which may be on the Website.

2.7. The User hereby agrees that the Rightholder of the Website shall not bear responsibility and shall not have direct or indirect liabilities to the User with respect to any eventual or arisen losses related to any content of the Website, registration of copyrights and information thereon, goods and services available on or obtained via external sites or resources or other contacts of the User which the User engaged in, using the information or links to external resources placed on the Website.

2.8. The User shall accept that all content and services of the Website or any part thereof may be accompanied with advertising. The User hereby agrees that the Rightholder of the Website shall bear no responsibility and shall have no obligations in connection with such advertising.

2.9. For registration on the Website services the Website User shall be liable to submit reliable and complete personal information for questions of the registration form. In case the User submits unreliable information of in case Midexpo has reasons to suppose that the information submitted by the User is not complete or reliable, Midexpo shall have the right at its sole discretion, to block or delete the User’s account and to prohibit the User to use its services (or certain functions thereof).

2.10. Midexpo shall reserve the right at any time to demand from the User the confirmation of data specified at registration as well as to request in this regard the evidencing documents, failure to provide which, at the discretion of Midexpo, may be deemed equivalent to provision on unreliable information and may involve consequences specified by Clause 2.9 hereof. In the event that the User’s data specified in the documents provided by the latter, do not correspond with the data specified at registration as well as in case where the data specified at registration do not allow to identify a user, Midexpo shall have the right to refuse the User to access the account and use of the Midexpo services.

2.11. The User’s personal data provided by the latter to the Rightholder of the Website will be processed in accordance with the data protection legislation of the Russian Federation as well as in accordance with the Personal Data Processing Policy (www.en.cstb.ru).

2.12. The Rightholder of the Website shall give no representations and warranties as to whether the Website will operate on a 24-hour basis with no interruptions but the Rightholder of the Website will make every effort therefor.

3. Other terms and conditions

3.1. All and any possible disputes arising out of this Agreement or in connection therewith shall be subject to consideration in accordance with the applicable legislation of the Russian Federation. Extrajudicial dispute settlement procedure shall be compulsory.

3.2. The Rightholder of the Website shall not consider anonymous claims or claims which give no possibility to identify the User on the grounds of contact data provided by the latter or claims containing no data specified in this Clause of this Agreement.

3.3. Nothing herein shall be understood as establishment of agency relationship, partnership relations, relations associated with joint activities, employment relationships or any other relations between the User and the Rightholder of the Website other than directly stipulated by this Agreement.

3.4. In case either provision hereof becomes null and void, the remaining provisions of this Agreement shall not be affected thereby.

3.5. Omission to act on the part of the Rightholder of the Website in case of violation by either User of provisions of this Agreement shall not deprive the Rightholder of the Website of its right to take the relevant actions later in defense of its interests and protection of intellectual and other rights to the Website content protected in accordance with the legislation of the Russian Federation.
